touch diamond back plate problems

I'm having an ongoing problem with my new Touch Diamond. The back will not stay put. It slides off if I hold it a certain way. I've contacted HTC and they asked if the tabs were broken. They are not. Is this a design problem with this phone? Has anyone else had or have this problem?
If you've corrected it, please fill me in.
